FREE TRIAL WEEK
The Participant is entitled to one (1) free trial week. During the trial week, the Participant may attend up to two (2) classes on any available training days offered by Dynamo Sports Center LLC.
The free trial week begins on the date of the Participant’s first class and expires seven (7) consecutive calendar days later.
ASSUMPTION OF RISK
I understand that participation in martial arts, wrestling, judo, Brazilian Jiu-Jitsu, sambo, fitness training, camps, clinics, competitions, tournaments, seminars, and related athletic activities involves inherent risks, including but not limited to physical injury, illness, disability, paralysis, property damage, and death.
I voluntarily assume all known and unknown risks associated with participation in these activities.
MEDICAL CERTIFICATION
I certify that the Participant is physically and mentally capable of participating in Club activities and has not been advised by a physician or healthcare professional to refrain from participation.
I agree to immediately inform Dynamo Sports Center LLC of any injury, illness, allergy, medical condition, medication, or physical limitation that may affect safe participation.
EMERGENCY MEDICAL AUTHORIZATION
In the event of an emergency, I authorize Dynamo Sports Center LLC and its representatives to obtain emergency medical treatment for the Participant when immediate medical attention is deemed necessary.
I understand and agree that I am solely responsible for any and all medical expenses incurred.
RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Florida law, I hereby release, waive, discharge, and hold harmless Dynamo Sports Center LLC, its owners, officers, employees, coaches, instructors, volunteers, agents, contractors, and representatives from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, attorney's fees, injuries, illnesses, disabilities, property damage, paralysis, or death arising out of or related to participation in any Club activity, including claims arising from the ordinary negligence of Dynamo Sports Center LLC.
I understand that this release is intended to be as broad and inclusive as permitted under the laws of the State of Florida.
PHOTO AND VIDEO RELEASE
I grant Dynamo Sports Center LLC permission to photograph, video record, livestream, and otherwise capture images and recordings of the Participant during Club activities.
I authorize Dynamo Sports Center LLC to use such photographs, videos, recordings, and media for advertising, marketing, website content, social media, promotional materials, and other lawful business purposes without compensation.
CONTINUING EFFECT OF WAIVER
I acknowledge and agree that this Waiver, Release of Liability, Assumption of Risk, Medical Authorization, and Media Release shall remain valid, binding, and enforceable for all visits, classes, activities, camps, clinics, seminars, tournaments, competitions, events, and participation at Dynamo Sports Center LLC.
This Waiver shall remain in effect after the expiration of any free trial period and shall continue to apply unless and until a subsequent written agreement specifically replaces it.
Continued attendance, participation, observation, or presence at Dynamo Sports Center LLC shall constitute acceptance of all terms contained in this Waiver.
If the Participant is under eighteen (18) years of age, the Participant's Parent or Legal Guardian acknowledges and agrees that this Waiver shall remain effective on behalf of the Participant for all future participation unless revoked in writing and accepted by Dynamo Sports Center LLC.
All releases, waivers, assumptions of risk, medical authorizations, media consents, and liability protections contained herein shall survive cancellation, suspension, freeze, expiration, termination of membership, or discontinuation of participation to the fullest extent permitted by Florida law.
GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the State of Florida.
ACKNOWLEDGEMENT
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, AND SIGN IT FREELY AND VOLUNTARILY.
